KESSTECH – a brand of MEC GmbH (hereinafter referred to as the "Manufacturer") – grants the end customer (hereinafter referred to as the "Customer") a warranty under the following conditions:

1. Guarantor, scope, warranty period and start date
   1. The exhaust system (hereinafter referred to as the "Product") supplied to the customer by our authorized dealers in Germany, Austria and Switzerlandshall be free from defects in materials or workmanship for a period of four (4) years from delivery.
   2. The warranty period begins with delivery to the dealer.
   3. The warranty applies exclusively to the original purchaser of the product and is non-transferable.
   4. The warranty does not apply to used products.
   5. In the event of a warranty claim, the customer must first contact the authorized dealer. This takes care of the warranty processing.
       
2. Scope of warranty
   1. Within the warranty period, the manufacturer warrants that the product is free from defects in materials and workmanship.
   2. The warranty service includes, at the manufacturer's option, a free repair, the replacement of defective components or the replacement of an equivalent new or refurbished product. The manufacturer will determine the type of service at its equitable discretion (§ 315 BGB).
   3. Replaced parts become the property of the manufacturer. The warranty extends exclusively to the free removal of material and workmanship defects, including the labor and material costs required for this.
   4. The warranty period of the product remains unchanged even if individual mechanical or electronic components are replaced.
       
3. Requirements for a warranty claim
   Claims under the warranty only exist if the following conditions are met:
   1. The defective product will be presented within the warranty period together with the original invoice, and the warranty holder must provide proof that he is claiming the warranty as the first purchaser.
   2. The product does not show any damage or signs of wear caused by use that deviates from the usual intended use and the specifications of the manufacturer or authorized dealer (as specified in the user manual and installation instructions).
   3. The product has been professionally installed by a contractor in accordance with the installation instructions.
   4. No repairs or other interventions have been carried out on the product itself by workshops or third parties not authorized by the manufacturer.
   5. In particular, no modifications have been made to the motor or electronics of the product.
   6. The product does not have any damage in transit or damage caused by incorrect or improper storage by the authorized dealer.
   7. The product has been cleaned according to the cleaning instructions and has no damage from incorrect cleaning.
   8. If available, accessories of the product are exclusively those of the manufacturer.
   9. The product's manufacturing number has not been removed or otherwise obscured.
   10. The motorcycle in which the product was installed does not exceed a mileage of 80,000 km at the time of claiming
        
4. Disclaimer of Warranty
   The following are excluded from the warranty:
   1. damage caused by improper assembly or failure to follow the installation and operating instructions;
   2. Damage that goes beyond the defective product. The warranty covers only the replacement product or the repair of the defective product. Damage to other objects, adjacent components or other consequential damage is excluded;
   3. In the case of brushed exhaust systems and carbon trims, discoloration is expressly excluded from warranty and warranty. Discoloration is a material and heat-related property and does not represent a defect. Due to discoloration, there is no entitlement to exchange or replacement;
   4. Normal wear and tear and wearing parts of the product;
   5. damage caused by external influences such as accidents, falls, force majeure (e.g. lightning, flooding);
   6. damage caused by improper cleaning or use of unsuitable cleaning agents (see cleaning instructions);
   7. damage caused by accessories or modifications to the product not approved by the manufacturer;
   8. damage caused by improperly installed cladding or manifolds;
   9. damage caused by incorrect assembly on a motorcycle model or year other than that intended for the product;
   10. damage caused by improper use, such as overheating due to tuning;
   11. Products mounted on motorcycles not intended for this purpose;
   12. Damage caused by transport damage or improper storage by the authorized dealer
        
5. Procedure in the event of a warranty claim
   In the event of a warranty claim, the customer must first contact an authorized dealer. The dealer is responsible for checking and processing the warranty. The customer must submit the following documents:
   1. Original proof of purchase or warranty card,
   2. Installation invoice,
   3. detailed error description,
   4. If applicable, photos or other evidence of the defect
      
      After receipt of the necessary documents by the manufacturer, the manufacturer will examine the warranty claim and the type of warranty service within 15 working days and inform the customer about the further procedure.
       
6. Customer's legal rights
   This warranty covers only the repair or replacement of the product in accordance with the above conditions. Further claims, regardless of the legal grounds, are not covered by the scope of the warranty and are governed by the applicable legal provisions. This warranty does not limit the mandatory consumer protection regulations of the country in which the customer resides, nor the statutory warranty rights or contractual claims of the customer against the seller under the purchase contract.
    
7. Applicable law and jurisdiction
   This warranty is subject to the laws of the Federal Republic of Germany. For consumers residing in another country, the mandatory consumer protection rules of their country of residence remain unaffected.
    
8. Validity of the German version
   This version of the warranty conditions has been translated into several languages for reasons of comprehensibility. In the event of contradictions or ambiguities between the German and another language version, only the provisions of the German version shall apply.
